Understanding All Your Options

Many older Americans, and their loved ones, must deal with a decline in their mental, physical, and emotional health. People are often afraid to ask for help, or they may simply not understand the services that are available to help them. There are many programs in place to help older people. It is important to stress that these programs are not welfare; they are not a government handout. These programs are in place to help people who have spent a lifetime contributing to the system.

Medicaid and Veterans' Benefits

A primary concern of the elderly is paying for long-term care, including nursing homes. In 2006, Congress overhauled Medicaid law, making eligibility requirements more stringent. Our firm understands you have very real concerns about qualifying for Medicaid without spending down all your assets and leaving nothing for you to pass onto your loved ones.

We can discuss strategies and options for meeting Medicaid eligibility requirements while helping you protect your assets. From Social Security to Veteran's benefits to Medicaid, we will give you an honest assessment and sound guidance on the programs that might help you.

Guardianships and Conservatorships

In addition to helping elder individuals develop asset protection strategies and get access to government health care programs, our firm offers experienced and knowledgeable guidance with establishing guardianships and conservatorships.

When a parent or loved one becomes mentally or physically incompetent to handle their own affairs, specific legal arrangements exist to protect their interests. In a guardianship, the court gives authority to an individual over the physical wellbeing of the ward, including decisions about living, bathing, feeding and medical care, while conservatorships address authority over the financial affairs of the ward. The guardian and conservator are often the same person, though not necessarily always so.

Disputes often arise among family members as to who will be the guardian or conservator. We have extensive experience in representing all sides of these disputes: We can represent the parent or ward, as well as the person who is seeking to become guardian or conservator. In all instances, our main priority is to our client and preserving, as much as possible, family harmony during a difficult period.
